REQUEST MY FREE CREDIT ANALYSISDebt collectors must follow strict rules. If a collector harassed you, threatened you or reported a debt incorrectly, you may have experienced a debt collection violation. Learn your rights in Los Angeles and how collection accounts can affect your credit report.
Common Debt Collection Violations
The federal Fair Debt Collection Practices Act (FDCPA) and the California Rosenthal Fair Debt Collection Practices Act prohibit abusive collection. Examples include:
- Calling before 8 a.m. or after 9 p.m., or calling repeatedly to harass
- Threatening arrest, jail or a lawsuit that is not intended
- Contacting your employer, family or friends about the debt
- Using false, misleading or abusive language
- Not sending a validation notice with the amount owed and creditor name
- Collecting fees or interest not allowed by your agreement or law
Credit Reporting Problems With Collections
The Fair Credit Reporting Act (FCRA) requires accurate reporting. Common problems include:
- Re-aged accounts that appear newer than the original delinquency date
- Wrong balances or the same debt reported by more than one collector
- Debts older than seven years still showing on your report
- Paid or settled collections still showing a balance
- Accounts that do not belong to you, possibly from identity theft
Steps To Protect Yourself
- Request written debt validation within 30 days of the first notice
- Ask collectors in writing to limit or stop contact
- Keep a log of calls, letters and dates
- Review all three credit reports for inaccurate collection entries
- Report violations to the CFPB, the FTC or the California DFPI
How A Credit Review Helps
Collections are often the biggest barrier between you and an approval. A review compares how each collection is reported against your records, identifies items that may be inaccurate or unverifiable and helps you plan for the accurate ones.
